Agricultural AI That May Have Higher Risk Classification
AI in Food Safety and Critical Infrastructure: AI managing critical food processing infrastructure or regional water supply for irrigation may face Section 2 classification if failure could significantly disrupt food or water supply. Agricultural Worker Management AI: AI assigning tasks, tracking productivity, or determining work allocation for seasonal workers is high-risk under Section 4 — farms using AI-based labor management have the same obligations as any employer using employment AI. AI in Agricultural Insurance and Credit: Crop insurance underwriting AI and agricultural lending creditworthiness assessment are high-risk under Section 5(b) — financial services AI provisions apply equally in agricultural finance.
CAP Administration AI
AI increasingly used in Common Agricultural Policy subsidy administration — both by farmers applying for subsidies and by national authorities processing applications — is likely to face AI Act scrutiny as public authority deployments affecting farmers' access to essential agricultural support.
