Legal AI: Powerful Tools, Complex Compliance
AI-powered contract analysis, legal research tools, litigation outcome prediction, e-discovery platforms, and document generation are being adopted across law firms, in-house legal teams, and courts. Legal AI intersects with some of the EU AI Act's most demanding requirements — particularly where AI influences access to justice or assists in judicial decisions.
Classification: Not All Legal AI Is High-Risk
Minimal/limited risk: contract review AI where humans make all decisions (limited risk if generating text that may be mistaken for human-written), legal research AI surfacing case law for lawyer review, document generation AI (requires transparency disclosure but not inherently high-risk). High-risk: AI used in judicial or administrative proceedings (Article III, Section 8), AI for legal aid eligibility determination, and AI used by law enforcement for investigative purposes (Section 6).
The "Predictive Justice" Problem
AI systems predicting litigation outcomes are limited-risk when used as advisory tools by litigators. They enter high-risk territory under Section 8 if they begin influencing judicial decisions directly — for example, if a court uses such a system for case management. Classification depends on the actual decision-making process, not just intended use.
Professional Ethics Dimension
Beyond the AI Act, legal professional bodies are developing AI ethics guidelines requiring lawyers to maintain AI competence, understand AI limitations, maintain client confidentiality when using AI (data processing agreements with LegalTech vendors), and disclose AI use to clients and courts where required by professional rules. Law firms must coordinate AI Act compliance with bar association AI guidance.
