AI in Manufacturing: Predictive Maintenance, Quality Control, and Safety AI Under the EU AI Act

Manufacturing is one of Europe's largest sectors and one of AI's fastest-growing applications. Here's how the AI Act applies to factory floor AI — from predictive maintenance to worker safety systems.

Manufacturing AI: High Value, Mixed Risk

Most process and operational manufacturing AI is not high-risk under the AI Act. Predictive maintenance AI, computer vision quality control, production scheduling, supply chain optimization, and energy management are generally minimal risk. The challenge arises where manufacturing AI intersects with worker safety, employment decisions, or critical infrastructure.

Which Manufacturing AI Is High-Risk?

Worker performance monitoring AI: Any AI system monitoring individual worker productivity, error rates, or behavior that feeds into employment decisions (performance reviews, task assignment, bonuses) is high-risk under Section 4. This includes warehouse productivity tracking, keystroke monitoring, and AI-based performance rating systems. Biometric safety AI: Driver fatigue detection from facial expressions, attention monitoring, and biometric access control to hazardous areas are high-risk under Section 1. Critical infrastructure safety AI: AI managing safety-critical processes where failure could cause serious injuries may face Section 2 classification.

The Machinery Regulation Intersection

AI integrated into industrial machinery must satisfy both the AI Act and the EU Machinery Regulation (2023/1230). The Machinery Regulation requires safety assessment, technical documentation, and conformity assessment for AI-integrated machinery — largely aligning with AI Act requirements but with distinct technical standards. Organizations planning capex investments in AI-integrated manufacturing equipment should assess both frameworks before finalizing specifications.

Key Action Steps

Categorize all AI use: process AI (mostly minimal risk), worker-facing AI (high-risk), safety AI (potentially high-risk). Audit any AI generating individual-level worker performance data. Engage works councils before deploying new worker monitoring AI. Require AI Act compliance documentation from all automation equipment vendors embedding AI. Coordinate AI Act and Machinery Regulation compliance through the same team.
