Marketing AI and the EU AI Act: Personalization, Behavioral Targeting, and What Consent Really Means

Marketing AI powers the modern digital economy — but targeting systems, sentiment analysis, and AI-generated content sit at the intersection of the AI Act, GDPR, and the DSA.

Marketing AI: Low Risk Under AI Act, High Complexity Overall

Marketing AI — recommendation engines, behavioral targeting, sentiment analysis, customer journey AI, and content personalization — is generally minimal or limited risk under the EU AI Act. Marketing AI doesn't typically fit Annex III's high-risk categories. But "minimal AI Act risk" does not mean "unregulated" — marketing AI sits at the intersection of GDPR, the Digital Services Act (DSA), the Consumer Omnibus Directive, and ePrivacy rules.

AI Act Obligations That Do Apply

AI-Generated Content Transparency (Article 50): AI-generated marketing content — blog posts, ad copy, social media content, product descriptions — must be disclosed as AI-generated when users might mistake it for human-created content. This applies to AI-generated email copy, social media posts as brand communications, and AI-generated product reviews. Chatbot Disclosure (Article 50): AI chatbots used for customer engagement must identify themselves as AI systems at the start of every interaction — including website chat widgets, social media DM bots, and WhatsApp Business AI. Prohibited Subliminal Manipulation (Article 5): AI specifically designed to exploit cognitive biases, create artificial urgency through personalized psychological pressure, or target vulnerable consumers with manipulative messaging is prohibited. The boundary between effective marketing and prohibited manipulation requires legal review for high-pressure AI-driven sales techniques.

GDPR and DSA Layer

Marketing AI using personal data requires GDPR legal basis review for AI-powered profiling (consent usually required for marketing profiles in automated decision-making). For marketing AI used by or on Very Large Online Platforms (VLOPs) under the DSA: advertising transparency (AI-targeted ads must be labeled with targeting parameters) and recommender system transparency (users must be able to opt for non-personalized alternatives) apply additionally.
