AI Regulatory Sandboxes in 2026: Where in Europe You Can Test Before You Comply
The EU AI Act mandates regulatory sandboxes to give innovators a controlled testing environment. But sandbox availability varies dramatically across member states. Here's the current landscape.
The Sandbox Mandate
Article 57 of the EU AI Act requires member states to establish at least one AI regulatory sandbox by August 2, 2026. These controlled environments allow organizations — especially SMEs and startups — to develop and test innovative AI systems under regulatory supervision before full market deployment, without being subject to all standard compliance requirements.
Current Sandbox Landscape
Spain (AESIA): Spain's dedicated AI Act regulator launched its sandbox program in late 2025, making Spain one of the earliest movers. The Spanish sandbox has focused initially on healthcare AI, financial services AI, and employment AI, with fast-track and standard streams. Finland (Traficom): Traficom was designated as national MSA and has operated AI sandboxes since before the AI Act, with particular expertise in transport and logistics AI. Finland was the first EU member state to fully operationalize its AI Act MSA. Germany (Distributed Model): The Federal Network Agency operates sandboxes for critical infrastructure AI; BaFin has established financial services AI sandboxes. Netherlands, Denmark, Sweden: Operational or near-operational sandbox programs with focus on cross-border collaboration through the Nordic AI sandbox network. Several member states are still establishing programs — companies in these markets may apply to another member state's sandbox under AI Act's mutual recognition framework.
Who Should Apply to a Sandbox?
Sandboxes are most valuable for SMEs and startups lacking resources for upfront full conformity assessment, companies developing novel AI applications with genuine regulatory classification uncertainty, organizations seeking regulatory pre-clearance in sensitive sectors, and innovators wanting to engage regulators as design partners. Large enterprises with dedicated compliance teams may find sandboxes less essential but still benefit from regulatory intelligence and goodwill generated by participation.
